HIPAA Privacy Rule
The HIPAA subpart that governs use and disclosure of PHI.
The HIPAA Privacy Rule sets the standards for how PHI can be used and disclosed, including minimum-necessary use, patient rights of access, and disclosure accounting. AI scribes must limit their use of PHI to what is necessary to generate the note and any explicitly contracted downstream tasks.
